Only identical matches of the marks registered at the Trademark Clearinghouse
may be registered during the Sunrise Periods. In scope of the application at
the Trademark Clearinghouse all readable supplements have to be specified.
Next to the disallowed marks (e.g. those which start with a preceding period or
dot) there are specifics regarding trademarks containing special characters.
The Trademark Clearinghouse has set up guidelines regarding replacement,
ommitance or transcribing of specific special characters.
Guidelines regarding special characters
Until now, the following guidelines regarding possible trademarks and
proceedings regarding special characters have been specified by the
Trademark Clearinghouse:
-
Special characters in the trademark, which may not be specified or used
by the Domain Name System, may be either (a) omitted or (b) replaced by
a hyphen.
-
Those special characters which may not be specified or used by the
Domain-Name-System (DNS) contained within the trademark (e.g. "@" or "&")
may be replaced by the matching terms in the appropriate official language
of the country where the trademark has been registered.
-
Special characters, which are allowed or usable by the Domain Name System
(DNS) have to be specified within the application (e.g. hyphens).
-
If the trademark contains special characters, which may be specified by the
Domain Name System (DNS), the special characters have to be used within the
application the Trademark Clearinghouse.
-
According to ICANN-IDN-Regulations, mixing up different IDN character sets
(e.g. greek, arabic, cyrillic, chinese or japanese characters) with each
other with latin characters, is not allowed.
Trademarks which use mixed character sets can unfortunately not be used for
a registration within the Trademark Clearinghouse register.
